SHERMAN, Conn. -- A Connecticut Superior Court judge has dismissed the charges against a 71-year-old Sherman man who was arrested earlier this year after 48 years as a fugitive from Georgia, according to the Hartford Courant.

Robert Stackowitz broke out of the Carroll County Prison Work Camp in Georgia in August 1968 while serving a 17-year prison sentence for robbery.

This past May, Stackowitz was taken into custody by US Marshals and arrested after blowing his cover by applying for Social Security benefits.

Late last month, Georgia's Board of Pardons and Paroles withdrew its request for extradition, and on Tuesday, Connecticut dismissed the fugitive from justice charge against Stackowitz, the Courant said.

Stackowitz, who suffers from bladder cancer, congestive heart failure, diabetes and breathing problems, told the Courant that he was happy to to stay in Sherman and wants to die in his home, not in jail in Georgia.
